Violation of any of these terms may result in immediate expulsion from the property without warning or refund

  1. TERM:
    1. The Term shall commence on the Check-in Date, and shall terminate on the Check-out Date. Guest agrees to strictly abide by all terms of this Agreement including occupancy, parking, check-in and check-out times, as well as all check-in and check-out instructions and rules and responsibilities at all times the Hotel is available to Guest.
  2. LICENSE IS NOT LEASE:
    1. Guests at the Hotel shall hold a non-exclusive license to use the property according to the terms of this agreement and shall never hold a lease on the property. 
  3. CHECK-IN / CHECK-OUT PROCEDURES:
    1. Check-In Procedures: Check-in time is 1:00 PM or later. Prior to arrival, Cosmic Suites will send to Guest instructions regarding access to the Hotel. Upon entering the Hotel, Guest agrees to follow all check-in procedures provided by Cosmic Suites, to examine the condition of the Hotel, and to immediately notify Cosmic Suites by email or a phone call if the Hotel or any of its contents are not in operating condition or are in disrepair.
    2. Check-Out Procedures: Check-out time is 11:00 AM or earlier. Guests shall review and comply with all check-out procedures provided by Cosmic Suites. Guests shall leave the Hotel in the same condition as existed upon check-in.
    3. Early Check-In or Late Check-out Requests: Requests for early check-in or a late checkout may be granted at Lessor’s sole discretion. All requests must be made 48-hours prior to the change in arrival or departure time. Extra fees will apply. For early arrivals or late checkouts that do not have prior written approval, guests will pay $125 per hour. Additional charges for holdover beyond 2 hours will apply.
    4. Forgotten Items: Lessor shall not be responsible or liable under any circumstances for any personal belongings, valuables or other items left at the Hotel. If any such items are located, Lessor will undertake reasonable efforts to notify Guest and to return them at Guest’s cost. Lessor shall not be responsible for any loss of, or damage to, any such items (in whole or in part), and this shall apply without limitation, to Lessor’s efforts in locating, holding, or returning any such items.
  4. CLEANING:
    1. Guest’s cleaning fee provides for typical cleaning by Cosmic Suites. The Hotel will be cleaned before the Guest’s arrival, and after departure. If additional, non-typical cleaning is required after the Guest’s stay, Guest will be charged for the extra time/costs at a rate of $60 per hour.
    2. Guests agree to allow the Hotel to inspect the Interior and Exterior of the suite at any time during their stay. Weekly inspections are routine but more frequent is possible. Guest is to ensure the integrity of the suite, evaluate any reported or unreported damage, verify the suite is being well maintained and cleaned, and complete a routine cleaning. Guests will leave the suite in good condition including cleaning counter surfaces, cleanup spills, clean floor and furniture, gather all trash inside and place in garbage receptacles. 
    3. Once a Guest is checked in, it is the responsibility of the occupant to wash all the linens and towels provided in the room.
  5. OCCUPANCY AND PARKING LIMITS:
    1. Meaning of Guest: Any duties, obligations, restrictions, or other provisions applicable to “Guest” hereunder shall apply equally and individually to each Co-Guest including any guests or visitors of Guest, whether or not such persons are authorized to be present on the Hotel. Guest and each Co-Guest shall be jointly and severally liable for any breaches of this Agreement and any and all resulting damages or losses.
    2. Register by name: Guest and Co-Guest must be registered by name to be allowed access to room or pool area. 
    3. Maximum Occupancy: 2 occupants per room.Guest understands and agrees that the Maximum Occupancy limit stipulated on the listing site includes children and infants, is strictly enforced, and shall not be exceeded at any time day or night during the Term without the express written authorization of Cosmic Suites in advance. Maximum occupancy also applies to the pool area.
    4. Parking Restrictions: Vehicles may only be parked within the marked parking spaces, but not in the parking spaces reserved by signs for permanent users. The hotel is entitled to move, or make arrangements to have moved, incorrectly parked vehicles by taking appropriate measures at the renter’s expense. 
    5. Each renter is advised to carefully lock his/her vehicle at all times after leaving it and not to leave any valuables behind.  
    6. The following are not permitted in the Parking Area: − Smoking and using fire, − storing fuel, fuel containers and inflammable objects, − unnecessary running of engines, − parking vehicles with leaking tanks or carburetor− refueling, repairing, washing or interior cleaning of vehicles − draining cooling water, fuel or oils − distributing advertising material.  
    7. The hotel excludes any liability for damage caused by other guest or other third parties. This applies, in particular, to damage, destruction or theft of the parked vehicle or movable/installed items from the vehicle or items attached to or on the vehicle.  
    8. The renter shall be liable for damage to the hotel culpably caused by himself/herself or by his/her vicarious agents, representatives or companions. The guest undertakes to report such damage to the hotel without being asked before leaving the Parking Area.  
  6. OCCUPANT:
    1. Primary occupant must be 18 years of age or older and must be a Guest throughout the Term. The name on the card or account used for payment must match the name of the occupant or must match the name of the parent or full-time employer of the occupant. 
    2. Occupancy of over 30 days does not alter the relationship between the Guest and the Hotel. All Guests are guests of the Hotel and never become tenants of the Hotel. 
    3. There is to be no visitors entering the property at any time. If an occupant is to have any visitors entering and exiting the property at any time, Cosmic Suites will terminate agreement without notice. 
    4. All occupants may be subject to background check. This agreement may be terminated if a background check shows that Guest has a recent criminal history of any kind. 
  7. RULES AND REGULATIONS:
    1. Never leave trash outside the suite.
    2. No hot plates allowed
    3. No pets allowed
    4. Smoking of any substance is not allowed on any part of the property. Minimum $250 fine per incident plus extra cleaning/damage costs.
    5. No open flames of any kind in rooms. No cooking outside microwave.
    6. There will be no drug use or selling of drugs of any kind on the premises. 
    7. Noise/Parties are not allowed: Excessive noise, rowdy behavior, loud music or other nuisances will not be tolerated by Cosmic Suites at any time. Quiet hours are between 10:00 PM and 8:00 AM and are strictly enforced. Guest expressly acknowledges and agrees that parties, excessive noise, or other similar disturbances can cause irreparable damage to Cosmic Suites business and agrees to pay all fines and fees and risks termination of the agreement as outlined herein as a Breach or Violation by Guest.
    8. Applicable Laws: Guest shall fully comply with all local, state, and federal laws while staying at the Hotel, including, without limitation, all association rules and city and county ordinances. Guest acknowledges that it is Guest’s responsibility to know, understand, and abide by all such laws and regulations.
    9. Guest agrees to strictly abide to these and any other rules or restrictions for the Hotel 
    10. Guests must report any problems with the property immediately to our service team. Do not call vendors for servicing. Accidental damage must be reported within 24 hours of occurrence.
    11. Do not open Cosmic Suites private closets/garages/storage shed(s).
  8. DAMAGE OR LOSS OF PROPERTY BY THE OCCUPANT:
    1. Guest shall be financially responsible for any damage caused to the Hotel, or resulting from Guest’s negligence or any breaches of this Agreement. Guest shall be responsible for any repair or replacement costs. This shall include, without limitation, any damage to landscaping, walls, furniture, appliances, cabinets, surfaces, stains/watermarks or scarring of floor surfaces, sheets, towels, bedding, items provided for your use, and misuse of appliances, equipment, and furnishings. Guest shall be responsible for any items that are missing, lost or stolen from the Hotel during Guest’s stay. 
  9. ACCIDENTAL DAMAGE:
    1. For  accidental damage, the damage must be reported within 24-hours of occurrence, no later than time of departure.
    2. Items covered for accidental damage are: stained linens and towels, desk ware, appliance damage, decorative items, furniture damage, wall scratches or dents, flooring, and any broken electronics
    3. Any covered damages that exceed $500 will be charged to the credit card on file.
    4. Items NOT covered: Excessive cleaning, pet damage, lost or missing items, theft, damage caused by negligence or not following provided instructions, landscaping damage, damage incurred from a breach of contract, damage caused while under the influence of alcohol or drugs, damage caused from operation of a motorized vehicle by Guest, damages related to smoking of any kind, TV cable/satellite/movie or phone charges, and amenity access. Any damage NOT reported by the Guest by the time of departure will not be covered. 
  10. AMENITIES:
    1. Generally: Linens and bath towels are provided by Cosmic Suites. Guest will notify Cosmic Suites immediately if any amenities are not available, inoperable, or become inoperable. Internet access is password protected.  There shall be no refunds or discounts if utilities/phone/internet/TV is not available or are inoperable.
    2. Particular Amenities: Guest understands the Hotel may not have all items Guest is accustomed to having in its own home.  Any specialty or particular items Guest is accustomed to using should be brought by Guest or purchased locally.
    3. Missing Items: Guest shall be responsible for the actual cost to replace any supplied item that is missing after check-out.
    4. Pool: If the Hotel includes a pool, special instructions for safety and maintenance apply, and the failure to abide by these rules will result in additional charges.  If a pool is improperly used and must be drained and refilled, extra maintenance costs will be charged to the Guest. Guest agrees to use the pool in accordance with posted rules, and to follow all provided maintenance guidelines. Pools and hot tubs may be closed for maintenance, repair, weather, or by civic order.  No refunds or discounts will be granted for any closure of a pool or hot tub.
  11. POOL AGREEMENT: 
    1. Pool Operation Hours: The swimming pool is open daily from 8:00 AM to 10:00 PM. Please respect these hours and refrain from entering the pool area outside of the designated times.
    2. No Lifeguard on Duty: Please note that there is no lifeguard on duty. Guests swim at their own risk, and children under the age of 12 must be accompanied by an adult at all times.
    3. Appropriate Swimwear: All guests are required to wear appropriate swimwear while using the pool. Management reserves the right to refuse entry to anyone not wearing suitable attire.
    4. Shower Before Use: To maintain the cleanliness and hygiene of the pool, we kindly request that all guests take a shower before entering the pool area.
    5. Pool Rules: Guests must follow all posted pool rules and guidelines. Failure to comply may result in management asking the guest to leave the pool area. This includes, but is not limited to, running, diving, excessive noise, and horseplay.
    6. Liability: Cosmic Suites is not responsible for any accidents, injuries, or damages sustained while using the swimming pool. Guests are responsible for their own safety and that of their children.
    7. Personal Belongings: Cosmic Suites management is not responsible for any loss or damage to personal belongings left unattended in the pool area. Please ensure that you keep your valuables secure at all times.
    8. Pool Access: The swimming pool is exclusively for the use of registered hotel guests. No visitors.
    9. Pool Safety: Running, jumping, diving, or horseplay is strictly prohibited in and around the pool area.
    10. Pool Capacity: To ensure the comfort and safety of all guests, pool capacity may be limited. Please respect the instructions provided by our staff members and signage.
    11. Food and Beverages: Food and beverages are not allowed in the pool area.
    12. Glassware Prohibition: For the safety of our guests, no glassware is permitted in the pool area.
    13. Health and Hygiene: Guests with open wounds, skin conditions, or any contagious illness are kindly requested not to use the pool facilities.
    14. Pool Furniture: Please do not reserve pool chairs or loungers by placing towels or personal belongings on them when not in use.
    15. Liability Waiver: The hotel is not responsible for any accidents, injuries, or loss of property that may occur while using the pool facilities. Guests use the pool at their own risk.
    16. By using our swimming pool, you agree to abide by these terms and conditions
  12. RELEASE OF LIABILITY, INDEMNIFICATION: Cosmic Suites or its agents shall not be liable for any damage or injury to Guest, or any other person or property, occurring on the property or any part thereof, during term of stay. Guest agrees to hold Comis Suites or its agent(s) harmless from any claims for damages if caused solely or in part by the negligent acts by, or omissions of, Guest or Guest’s guests. All Guests and Guest’s guests shall be jointly and severally liable for all terms and conditions as set forth in this agreement. Guest indemnifies and releases Cosmic Suites, and their agents from all liabilities relating to the use of the property.  This indemnification includes, but is not limited to the Hotel’s interior, exterior, ingress, egress, fixtures, appliances, heating and cooling systems, structures, and any common areas, stairways, yard areas, barbeques, other amenities, and any swimming pools, and any surrounding areas, 
  13. CANCELLATION / REFUND POLICY:
    1. Cosmic Suites may cancel this Agreement prior to Check-in if the Guest does not meet the age requirements or the number of guests will exceed the approved occupancy listed in this agreement. Cosmic suites will refund all Accommodation fees and taxes.
    2. The Hotel reserves the right to cancel a reservation without cause even after Check-in. If canceled without cause, Hotel will offer a prorated refund to the Guest.      
  14. AS IS: Guest understands it is renting the suite on an “as is” basis.  Should Guest become dissatisfied with the Hotel for any reason, Cosmic Suites will make every reasonable effort to resolve any specific problem(s). However, there shall be no refunds or relocations of any kind, in whole or in part, unless otherwise expressly provided herein. This refund policy shall apply, without limitation, to (i) any early departure/check-out by Guest or shortened stay; (ii) any claims that the Hotel or amenities are unsatisfactory, inoperable, or otherwise defective (including, but not limited to, issues with Internet service, cable service, décor, appliances, utilities, plumbing, pests, the quality of furnishings/linens, pool, spa, etc.); (iii) adverse or unexpected road conditions, weather conditions or act of nature; (iv) any unforeseen circumstances due to financial, health or family emergencies, or (v) any other similar issues, complaints, or circumstances.
  15. DEPOSIT:
    1. A deposit is charged at time of booking which will serve as both a holding deposit and a security deposit. 
    2. If the Guest does not complete the booking, they will not be refunded this deposit. 
    3. If the Hotel finds that the Guest does not meet requirements to stay before check-in, the Hotel will refund the full deposit. 
    4. This deposit will be retained by the Hotel for the full term of the stay and will be refunded to the guest after check-out minus any unpaid charges or damages.
    5. If a Guest violates any terms or conditions in this agreement, they will immediately forfeit their deposit as damages.
  16. PAYMENT SCHEDULE: Method of Payment: By entering into this Agreement and providing Guest’s credit card information, Guest expressly authorizes Cosmic Suites to charge Guest’s credit card or as set forth herein, and acknowledges that any such payment(s) will be automatically charged without further notice to Guest. All payment(s) shall be non-refundable unless otherwise expressly provided herein. Guest will pay Cosmic Suites a charge of $50 for each returned/dishonored payment.
  17. PAYMENT AND APPROVAL INFORMATION: Approval Requirement: You must be 18 years of age or older and an Guest during the entire Term Booking Online: By booking your reservation online, Guest acknowledges that Guest has read, understands, accepts and has received a copy of this Agreement in its entirety Payments: Guest may make payments through the listing site. Guest expressly authorizes Cosmic Suites to charge Guest for fees and services set forth herein that have not been paid to the listing site. All payment(s) shall be non-refundable unless otherwise expressly provided herein. Guests will pay Lessor a charge of $50 for each returned/dishonored payment.
  18. TERMINATION OF AGREEMENT: Guest understands that if any of the terms and conditions listed above are broken, Cosmic Suites have the right to terminate agreement at any time without notice. If the occupant or their visitors causes any issues such as harassment to other guests or employees, aggression, intimidation, destruction of property, any foul behavior, and receives several complaints against them, Cosmic Suites will terminate the agreement immediately without notice. Cosmic Suites has the right to not accept any rebooking made by occupants that have previously had the agreement terminated. 
  19. UPDATES TO AGREEMENT: This agreement is subject to change based on the needs of the Hotel at any time. By choosing to stay at the Hotel the Guest consents to these changes to terms and conditions. 
  20. Guest acknowledges that Guest has read, understands, accepts and has received a copy of this Agreement in its entirety and authorizes Cosmic Suites to use Guest’s phone and email for text, voice, and written communication.
